KEY REGULATORY ENGAGEMENT CONSIDERATIONS FOR
CHANGE MANAGEMENT PACKAGES & SERVICES
1. Whilst Passion Pioneers takes all due care in providing Change Management packages and the associated business advisory and coaching services, Passion Pioneers does not provide any warranty either express or implied including without limitation warranties of merchantability or fitness for a particular purpose.
2. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.
Limitation of Liability
3. As outlined in Schedule 2 of the Competition & Consumer Act 2010 :
To the full extent permitted by law, Passion Pioneers’ liability for breach of an implied warranty or condition is limited to the supply of the services again or payment of the costs of having those services supplied again, if the package, coaching or business advisory services is found to be at fault for Your issue.
Passion Pioneers accept no liability for any loss whatsoever including consequential loss suffered by You arising from services Passion Pioneers have supplied.
Passion Pioneers do not accept liability for Your implementation of the coaching or advice we have provided.
4. To the maximum extent permitted by law, Passion Pioneers gives no warranties, and shall have no liability to Your organisation in relation to:
Use or implementation of Your organisation’s Change Management solution or systems and products;
Unsuitability of the Change Management Package or associated services for any specific purpose;
The implementation of any advice, referral, system or idea that may be provided during, after, or as part of providing the Change Management Package.
5. Your organisation agrees to participate in data collection activities (including surveys, workshops, focus groups and other methods of collecting information from Participants in the Change Management Package) conducted by You the employer to evaluate the Change Management program best suited to Your organisation.
6. Passion Pioneers agrees to be bound by Government Regulations regarding current methods for meeting and collecting information to undertake the Change Management Program and the associated business advisory and coaching services.
7. By accessing our Change Management Package and associated business advisory and coaching service, You agree to indemnify and hold Passion Pioneers harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with Our engagement in Your business.
